Tikoca appeals AG defamation case Former Social Democratic Liberal Party member of parliament Ratu Isoa Tikoca has filed an application in the Suva High Court to set aside the interlocutory judgement by the High Court.

Tikoca was ordered by the High Court to pay Attorney-General Aiyaz Sayed-Khaiyum $80,000 as total damages within 30 days.

Sayed-Khaiyum had filed a writ of summons against Tikoca and sought relief in damages for libel and slander, punitive exemplary and aggravated damages.

The writ of summons also included an order that Tikoca renders in writing a public retraction and apology to Sayed-Khaiyum to be published in the daily newspapers.

Tikoca through his lawyer, Tikoca Junior told the court today that they were not issued a writ of summons regarding damages resulting from the defamation.

Judge justice Vishwa Sharma then said the onus was on Tikoca to come to court and counter the assessment of damages but he did not do that.

He has ordered Tikoca to file a response in 21 days and for both parties to file further responses by 5th November.

Justice Sharma said the writ was served but no action was taken by the defendant and in absence of that, an assessment on the damages was delivered by the court.

Sayed-Khaiyum's lawyer, Devanesh Sharma told the court that they are opposing the application by Tikoca.

The matter has been adjourned to November 8.
