Woman gets 35 months for manslaughter

Reapi Namosimalua, 26, has been sentenced to 35 months for manslaughter after leaving her two-year-old son unattended near a creek which resulted in him falling into the sea, and drowning.

Namosimalua was found guilty of Manslaughter arising out of breach of Duty, contrary to sections 240 and 241(2) of the Crimes Act 2009.

The Court heard that the accused left the toddler under the care of a 12-year-old when she cleaned the kitchen and the dining area which was separated from the main house.

The Court also heard that the grandparents of the 12-year-old had sent her to the canteen, leaving the toddler behind with nobody attending to him.

The toddler was found lying motionless beside the seawall.

The post-mortem examination report stated that the deceased died from asphyxiation due to drowning.

The Court noted that the accused is a first offender, separated, engaged in domestic duties, who pleaded guilty and cooperated with the police during the investigation.

In addition to the above, the accused is to undergo general and parental counseling facilitated by the Social Welfare Department or an NGO recommended by the Social Welfare Department. A copy of this sentence is to be given to the Social Welfare Department.

The accused is ordered to comply with the above orders failing which she will be subjected to due process of committal.

The accused has 30 days to appeal the matter.
