Turaga disputes $3m payable to Sharma by Court

The Government agrees that the termination of the former Solicitor-General Sharvada Sharma was unlawful as per the decision of the Civil High Court, last month.

The Civil High Court ruled that Sharma will not be contracted back to his former position, due to the fact that the position is currently held by someone else, which the Government also agrees with.

Speaking to FijiLive, Attorney-General Siromi Turaga said questions must be directed to the FijiFirst Government on why Sharma in this case a Constitutional Office Holder, was unceremoniously dismissed when there are provisions in the constitution that must be followed, if there are claims of alleged misconduct.

Currently, Turaga said the Government is setting in place two tribunals to look into two separate matters of misconduct.

In the case of Sharma, Turaga has disputed the amount payable to the former Solicitor–General, as the claims in damages were not particularised.

“This is very basic law. When you claim damages, you must particularise what is what. That was not done in this case, but somehow the Court came up with this amount in its ruling.”“We are not entirely satisfied,” Turaga said.

The matter to appeal the ruling, the Attorney-General said this must be taken up by the Judicial Services Commission, they would decide to appeal the matter or not.

Turaga said his office, only, represented the Office of the President in the matter and no one else.

FijiLive is also reaching out to the Acting Chief Justice, Honourable Salesi Temo, who is also Chair of the Judicial Services Commission, for comments.
