Taniguchi judicial review case now for March

The judicial review case filed by Ari Taniguchi, the wife of the former National Federation Party proposed candidate, Hiroshi Taniguchi, has been adjourned to 21 March for mention.

The matter was called yesterday before Chief Justice, Kamal Kumar in the Civil High Court in Suva.

Lawyer, Hemendra Nagin, who represented the Leader of the National Federation Party, Professor Biman Prasad, the interested party in the matter, said that his client had not been served with a copy of the judicial review notion of motion.

The Counsel representing Ari Taniguchi told the court that he only served the notices to the Office of the Attorney-General and the Office of the Director of Public Prosecution.

He said under Order 53 (3)(b), they are not entitled to serve an affidavit to the affected party, in this case, Prof Prasad.

Nagin responded that in the document, the name of Prof Prasad was mentioned after almost every paragraph.

The court ruled that the applicant serve a supplementary affidavit to the interested party so that a reply would be ready for 07 March for review.

The judicial review filed by Ari Taniguchi was due to the decision taken by the ODPP last year to drop the case after a comprehensive review of the evidence and defences available to the leader of the National Federation Party.

Director Christopher Pryde had earlier stated that it had been decided that there was insufficient reliable and credible evidence in the docket for a reasonable prospect of conviction, were the matter to proceed to court.
