Constitution can be challenged in court: Narube

Unity Fiji Leader, Savenaca Narube believes the 2013 Constitution can be successfully challenged in the appropriate Court in Fiji and they are exploring this option.

Narube in a statement said they intend to comply with all the legal and administrative processes that are necessary.

“We plan to consult closely with the military. We will be forward looking. We will design a transition plan to a new Constitution,” he said.

“We must not allow this imposed Constitution to destroy the hopes of our future and details of our national campaign will be released in due course.”

“The first sentence of the 2013 Constitution states, “We the people of Fiji”…this statement is false as people of Fiji did not participate whatsoever in the preparation of the 2013 Constitution.”

“This is a fundamental mistake that must be corrected. The Constitution is for the people and therefore the people should have a say in its preparation.”

“The people should approve the Constitution through the Parliament. The 2013 Constitution has not been passed by any Parliament. It was decreed by the 2006 coup makers.”

“Therefore, we can confidentially conclude that the 2013 imposed Constitution is not the Constitution of the people of Fiji. It was imposed on the people through the barrel of a gun. The people had no choice but to comply with the imposed Constitution.”

He said the manner in which the 2013 Constitution was imposed on the people reflected the dark intentions of the framers.

“They made it extremely difficult to change the Constitution. They inserted a wide role for the military and an immunity clause to protect the coup makers.”

“They entrenched the electoral system and other important issues in the Constitution so they cannot be changed.”

“We must not allow the imposed Constitution to limit our progress to peace, prosperity, and unity in our beloved country,” he added.
