Social Democratic Liberal Party member Seremaia Tuiteci has written to the Registrar of Political Parties alleging that the Party breached Section 13 of its Constitution.
In the letter which has been verified by FijiLive, Tuiteci said the breach occurred when a Management Board Meeting was convened, and resolutions were passed without meeting the required quorum of 51 percent of the total number of board members.
Tuiteci drew the attention of the Registrar of the Political Parties to Schedule 1(5) (b) of the Political Parties (Registration, Conduct, Funding, and Disclosures) Act 2013, which mandates that every Political Party must adhere to and uphold their respective Political Party Constitution.
“Given these circumstances, I express my concerns regarding the management of Party affairs by the General Secretary, Authorised Officer, the President, and the Vice-Presidents of the Party,” he wrote.
“It appears that they have overlooked the provisions of the Party Constitution, thereby causing the Party to contravene the Political Parties (RCFD) Act, 2013. This situation bears resemblance to the circumstances that led to the Party’s suspension in May of 2020.”
Tuiteci said As per Section 6(3)(f) of the Political Parties Act 2013, all registered Political Parties are obligated to abide by the Act and the Code of Conduct outlined in Schedule 1.
He claimed that SODELPA’s Office Holders may have committed an offence as defined under the Act and called on Mataiciwa’s intervention as per Section 27(5) of the Act.
